This is a two-stage application that allow the de facto partner or spouse of Australian citizen or Permanent residence to live in Australia. Stage 1 is The Partner (Provisional) Visa (subclass 820) is a temporary visa. This visa allows the applicant to live in Australia for two years and meeting with their ongoing obligations for partner visa application subclass 801.
Eligibility for onshore partner visa
- Applicant is married or in a de facto relationship with Australian Citizen or permanent residence. In case of de facto relationship your relationship needs to be register with Australia Government or you need to be in de facto relationship for 12 months.
- Applicant and sponsor must be at least 18 years of age
- Your relationship is genuine, continuing and mutually exclusive
- You live together or do not live separately and apart on a permanent basis
- You meet the Australian health requirements
- You and your sponsor meet the character requirements
Obligations for Sponsors
Sponsors is responsible for following obligation for two years after grant of subclass 801 visa.
- Accommodation
- Financial support including English language courses if require
- Other support like childcare if require
Stage 2 The Partner Visa (Migrant) (Subclass 801) is a permanent residency visa. Department will send the invite after one/two years depends on your circumstances. This is a five-year visa and give you opportunity to live in Australia for five years and opportunity to apply for Australian Citizenship.
