Offshore Australian Partner Visa application is a two-stage application which is Partner (Provisional) Visa (subclass 309) and Partner Visa (Migrant) (Subclass 100)
- Stage 1 The Partner (Provisional) Visa (subclass 309) is a temporary visa. This is a two-year visa which is granted to the applicant to migrate to Australia temporarily. By holding this visa you can work, live and study in Australia.
- Stage 2 Usually after one/ two years department of immigration send the invite to applicant to lodge the permanent visa subclass 100. To eligible for this visa, you must be in continued relationship with your sponsor and abide with Australian law and conditions of subclass 309 visa. This is a permanent visa and length of visa is five years and you can apply for Australian Citizen during that period of time.
Eligibility for offshore partner visa
- Applicant is married or in a de facto relationship with Australian Citizen or permanent residence. In case of de facto relationship your relationship needs to be register with Australia Government or you need to be in de facto relationship for 12 months.
- Applicant and sponsor must be at least 18 years of age
- Your relationship is genuine, continuing and mutually exclusive
- You live together or do not live separately and apart on a permanent basis
- You meet the Australian health requirements
- You and your sponsor meet the character requirements
Obligations for Sponsors
Sponsors must provide following things for two years after the applicant enters Australia on temporary migrant 309 visa
- Accommodation
- Financial support including English language courses if require
- Other support like childcare if require
