The applicant for a visa must

    • Possess a TSS, subclass 457, or relevant bridging visa. A, B, or C

    • Possess a nomination from an Australian employer that was accepted six months before the application was submitted.

The holder of this visa will be able to:

  • Sign up for Medicare, the national health care programme in Australia.

  • If you are eligible, apply for citizenship in Australia.

There may be a waiting period before newly arrived residents can receive certain benefits and payments from the Australian government.

Duration of Stay

The holder of this permanent visa is permitted to stay in Australia for an extended period of time.
The date of visa issuance marks the start of permanent residency.
In order to become a citizen, permanent residency begins:

  • If the holder is in Australia on the day the visa is granted.
  • If the holder is outside of Australia, on the day they enter the nation using this visa.

Including Family Members

Applicants may:

  • When submitting their initial application, list family members.
  • Include family members after submitting the application, but prior to the visa being granted.

Family members who qualify for this visa include:

  • The partner of the applicant
  • The dependent child or stepchild of the applicant
  • The dependent child or stepchild of the partner
  • The dependent child or stepchild of the partner or the applicant.

Furthermore, if a person's subclass 457 or subclass 482 visa was issued because of their status as a family member, they may also be included.
Family members requesting a visa must fulfil certain character and health requirements. These requirements might also apply to those who do not apply with the primary applicant.

Cost

The primary applicant must pay AUD 4,770 for the visa.
For every family member listed on the visa application, there are extra fees.

Second instalment

A second instalment is an extra fee that needs to be paid for any family member who is eighteen years of age or older and who:

  • has less than functional English and applies for the visa alongside the primary applicant. For every family member, the second instalment is AUD 4,890.

An invoice will be sent out after all other visa requirements have been satisfied, if this payment is necessary.

Other costs

Police certificates, biometrics, and health checks may incur additional fees.

Location of Application

This visa is available for application both within and outside of Australia. You must have either a relevant bridging visa (A, B, or C) or a substantive visa if you are applying from within Australia.
You might still be able to apply in Australia in some situations even if your substantive visa has a "no further stay" clause.
When your application is evaluated, you may be within or outside of Australia.

The processing of your application might take longer if:

  • It is not properly completed.
  • There are missing necessary documents, or more information is required.

Your application will not be processed if the appropriate visa application fee is not paid. If this happens, you will be informed and your application might be sent back.

Obligations

All Australian laws must be complied with by you and your family.

It is anticipated that you will spend at least two years working for the company you are nominating.

Additionally, you have to consent to starting work within six months of:

if the visa was issued while you were outside of Australia, entering the country
If your visa was granted while you were in Australia, the date of grant.

Travel

The holder of the visa has up to five years from the date of issuance to travel to and from Australia.
To return to Australia as a permanent resident after this time, a Resident Return (RRV) visa will be needed.
The holder of the visa may not be allowed to return to Australia as a permanent resident if they depart Australia after the travel facility expires and have not been granted another permanent visa with a valid travel facility (such as a Resident Return (RRV)).

Visa Signature

1. Necessary Competencies
The candidate must possess the abilities and credentials required to carry out the duties of the chosen profession.

It might be necessary to request a skills assessment to prove that these abilities are present.

2. Membership, Registration, or Licencing
In the event that it is required in the state or territory where the visa holder plans to work, they must be licenced, registered, or a member of a professional body.

3. Nominated by a Workplace
The Australian employer nominating the visa holder must be one whose company is:

  • Operating in Australia actively and legally as a party to a labour agreement
  • Examine the applicable guidelines to find out if the employer is qualified to nominate. No visa will be issued if:
  • Negative information concerning the proposer or any connected individual exists, unless it makes sense to ignore it.
  • The withdrawal of the nomination
  • The job is no longer open.

An existing visa application cannot be connected to a new nomination. One course of action in this case would be to withdraw the current visa application and file a fresh one pertaining to the revised nomination.

A refund of the visa application fee might be possible, depending on the situation.

4. Minimum Age Requirement
Normally, the applicant's age at the time of application cannot exceed 45.

This age requirement is not applicable if:

  • An Australian university has nominated the applicant as an academic (a lecturer or faculty head at Academic Level A, B, C, D, or E).
  • An Australian university or scientific government agency nominates the applicant as a scientist, researcher, or technical specialist at ANZSCO skill level 1 or 2.
  • The candidate is nominated as a medical practitioner who has worked in that capacity in a designated regional area of Australia for at least two years as a subclass 457 or 482 visa holder in the three years prior to applying; additionally, the nominated position is located in a designated regional area of Australia.
  • The applicant must have held a subclass 457 or 482 visa and worked in the designated occupation for the nominating employer for at least two of the three years prior to applying, with earnings for each year exceeding the Fair Work High Income Threshold.

5. English Language Requirement
The candidate's English proficiency must be at least competent.
There are currently no exceptions to the English language proficiency requirement for this visa stream as of November 16, 2019.

6. Visa Requirement
As the primary visa holder, the applicant must currently possess one of the following:

A 457 subclass visa (of any kind) A visa under subclass 482 (TSS) (any stream)
A visa for bridging A, B, or C
The subclass 457 or TSS visa must have expired before the bridging visa could be issued.

7. Health Requirements
The applicant must fulfil the health requirements, as must any family members applying with them. It is also possible to request health information for family members who are not travelling to Australia with the applicant.

8. Character Requirements
The applicant must meet the character requirements, as must any family members applying with them who are 16 years of age or older. Character references for family members who aren't travelling with the applicant to Australia may be asked for.

9. Signature on the Australian Values Declaration.
If the candidate is at least eighteen years old, they have to:
have either read the "Life in Australia" booklet or have given them an explanation.
Sign an Australian Values Statement attesting to their intention to uphold Australian law and the way of life.

10. Pay Back Debts to the Government of Australia
If the applicant owes the Australian Government money, it must be paid back in full or they must have a formal plan in place to do so.

11. Visa History
The applicant's immigration background will be taken into account when evaluating their application. If they have previously had a visa cancelled or had an application denied, they might not be eligible for this one.

Visa outcome
The decision on your visa application can be made whether you're inside or outside Australia. Before a Temporary Skill Shortage (TSS) visa is granted, your employer's nomination must be approved. You'll be informed in writing about the outcome, including visa details if approved, or reasons for refusal and potential review rights if denied. The application fee is non-refundable in case of refusal.

Arriving in Australia

Before You Depart

Ensure you have the following:

    • A valid visa for entry into Australia
    • A valid passport or other acceptable travel document

New Zealand passport holders

If an immigration officer processes clearance at the border, it is recommended that the individual inform them:

  • They hold a permanent Australian visa
  • They do not wish to obtain a Special Category visa (subclass 444)

Failure to provide this information may result in the issuance of the 444 visas, which will override the permanent visa and could impact eligibility for Australian citizenship.

This visa allows the holder to:

  • Remain in Australia indefinitely
  • Work and study in Australia
  • Enrol in Australia’s public health care scheme, Medicare
  • Sponsor eligible relatives to come to Australia
  • Travel to and from Australia for 5 years

Permanent residency for citizenship purposes starts on the:

  • Day of visa issuance, if the holder was present in Australia on that day
  • Day the holder, if issued while they were outside of Australia, enters Australia using this visa
